1. identity of the person in charge of the treatment

IMMO MAT ET SEB, a company with a capital of €10,000.00, registered in the Trade and Companies Register under number 528 557 614 and whose head office is located at 1, rue Saint-Paul 34000 MONTPELLIER (hereinafter referred to as "the Company"), this company acting on behalf of itself as well as on behalf of the member companies of its group.

2. Terminology

User: any natural person, using the services or the Site of the Company as a customer or simple visitor of the Site.
Site: this is the Company's mat-seb-immo.com site.

3. Collection, conditions and purposes of data processing

The Company collects personal data (surname, first name, home and e-mail address, telephone number, IP address, photos of the property, etc.) from the User browsing, consulting and/or entering personal information on our Site in order to have access to our services.

This data collection is carried out when the User :

  • subscribes to newsletters or alerts offered by the Company, makes a request to return to the site
  • contacts the Company's Customer Service by any means of communication available to him/her, such as e-mail, instant messaging (chat), telephone, etc.
  • browses the Site and consults articles
  • writes a comment or an opinion on an article
  • shares a review with a friend by sending an e-mail from a file
  • shares a review via Facebook, Google+, Twitter, linkedin, Instagram or Pinterest from an article page
  • fills out a form to enter information or correspondence on the Site

The data collected is necessary for the following processing:

  • Management and follow-up of commercial relations between the Company and the customer (in particular operations relating to the search for goods for purchase, the search for goods for sale, real estate transactions, payments and invoices, complaints, information etc.).
  • Sending commercial prospecting (see paragraph "Newsletters" below)
  • Personalization of the contents of the Site, display of targeted advertisements, particularly on social networks.
  • Sharing of information with our partners in relation to the Company's activity (real estate websites/portals, real estate agencies, agency networks, craftsmen, notaries, trustees, insurance companies, banks, etc.), hereinafter referred to as "Partners".
  • Provision of sharing buttons to social networks
  • Realization of statistics of audience measurement and marketing studies
  • Prevention and fight against fraud
  • Forms and questionnaires

The User must fill in all mandatory fields of the forms, information entry or correspondence on the Site, with the exception of fields displayed as optional, i.e. not marked with an asterisk. Optional information is collected by the Company and is used to better know the Users of the Site.

Recipients of the data

The data collected is intended for use by the Company. The data may be transmitted to partners in connection with the Company's activity, police or judicial services in the context of legal requests.
The data may also be processed by subcontractors used by the Company for the creation, updating, maintenance and storage of databases, in order to provide the Company's services and to prevent and combat fraud.

4. Rights and protection of the User

Right of access, rectification and deletion of data; right to object to processing.

The User has the right to access, rectify and delete data concerning him/her. The user can expressly oppose the processing of his personal data. To do so, he/she should write a letter to the Company, 1, rue Saint-Paul 34000 MONTPELLIER or fill in the online correspondence form.
The User shall indicate his name, first name and postal address. His request must be signed and accompanied by a valid ID bearing his signature. The User may specify the address to which the reply should be sent.
The Company has a period of 1 month from receipt of the User's request to respond. At the end of this period, the Client may refer the matter to the CNIL in the event of a negative response or lack of response from the Company.

Data portability

The User has the right to the portability of personal data processed in an automated manner which gives him/her :

The right to receive his/her personal data in a structured format
The right to have personal data transmitted directly from one data controller to another, unless this is technically impossible.

Transfer of personal data outside the European Union

Personal data is stored, hosted and processed within the European Union.

Data retention period and right to be forgotten

  • The Company retains data for a period of five years from the end of the relationship with the client or prospect. The period begins either with the last transaction carried out, or the last request made, or the last call to customer service, or the sending of an e-mail to customer service, or a click on a hypertext link in an e-mail sent by the Company, or a positive response to an e-mail asking whether the customer wishes to continue receiving information or alerts after the five-year period has expired.
    Nevertheless, information that can be used to establish proof of a right or a contract, or that is kept in order to comply with a legal obligation, may be archived in accordance with the legal provisions and requirements in force.

At the end of this period, the data of the customer or prospect will be completely anonymized or destroyed.

  • Notwithstanding the foregoing, the User has the right to forget and delete personal data processed by the Company, subject to the Company's right to retain certain data in respect of its professional civil liability, its tax obligations, and legal requirements.

The User must notify his or her request in the same manner as provided for the right of access above.

Fate of personal data after death

The Company informs the User that he/she may define, during his/her lifetime, directives concerning the conservation, deletion and communication of his/her personal data after his/her death. These directives may be general or specific. The User can modify or revoke his directives at any time. To do so, the User may contact the Company under the same conditions as for the right of access provided above.

Specific functions

  • Company Newsletters - Email Alerts

At the time of registration and subsequently in the management of his preferences, or depending on the choice of certain services, the User may subscribe to the Company's newsletter or to e-mail alerts and thus choose to be informed at regular intervals of the offers proposed. The User may, at any time, unsubscribe by clicking on the link provided for this purpose located at the bottom of each newsletter.

  • Sms / mms

The Company may use the customer's cell phone number to communicate offers, requests and alerts. At any time the customer has the possibility to oppose it in a simple and free way, or to unsubscribe from the alerts, on the Site in the heading "My account", or via the form of correspondence or by postal mail to the following address: 1, rue Saint-Paul 34000 MONTPELLIER.

  • Cookies

Definition of a cookie
A cookie is a small text file that is placed or stored on your terminal (computer, tablet or mobile device) when you visit a website. The cookie allows a site to recognize you, to help you navigate from page to page on a website, provides secure connections and remembers your preferences for future visits.
The Company uses cookies to recognize the User (customer or not) when he/she connects to the Site. They are anonymous and do not collect or store any personal data.

Deletion of cookies
The User may at any time deactivate the cookies stored on his terminal. To do so, he/she can use the button provided for this purpose on the legal notice page or select the appropriate settings in his/her browser and consult the help menu of your browser.
However, this deactivation may result in preventing access to certain features of the Site that allow the personalization of the services offered by the Company.

  • Web Beacons

The Company uses web beacons on certain pages of the Site to count the number of visitors to the page and to update the site. These web beacons may be used with some of our partners, in particular to measure and improve the effectiveness of our services. The information collected via these web beacons is anonymous and allows us to know the frequentation of certain pages of the Site, in order to better assist the Users of the Site.

  • Social Network Plugins

The Site uses social network plugins such as Facebook, Twitter (hereinafter "Social Networks"). For example, if the User is connected to Facebook while browsing the Site, Facebook will be able to link the User's visit directly to the User's Facebook account even if the User did not use the share button.
If the User interacts with the plugins, for example by clicking the "Like" button or leaving a comment, the corresponding information will be transmitted to and stored on a Facebook server. This information will be posted to the User's Facebook account.

The Company does not manage the data collected by the Social Networks via the buttons. The User should read the policy on the protection of personal data published by the Social Networks concerned in order to know the methods of processing and use of the data collected by the latter as well as the possible settings available to protect his/her privacy.
If the User does not want the Social Network to link the information collected through the Company to his Social Network user account, he must disconnect from the Social Network before consulting the Site.

Security measures taken by the Company to ensure the protection of personal data

The Company implements all appropriate technical means in accordance with the rules of the art, to maintain the integrity, digital and physical security, and confidentiality of data and in particular to prevent them from being distorted, damaged, or accessed by unauthorized third parties, in particular by implementing encryption, access codes, firewalls, anti-virus and all other appropriate technical means.
